Non-payment of charges and debt
24. Non-payment of charges and debt
Carmarthenshire will pursue outstanding charges and debts through the most appropriate channels including recovery action through the courts where appropriate. In such instances Carmarthenshire will also recover all costs and apply for interest on the amount to be recovered.
Carmarthenshire will charge interest at the general rate on all Social Care debt 91 days after it becomes due (apart from debt secured under a Deferred Payment Agreement).
For Non-residential care debt that cannot be collected when due, Carmarthenshire may apply for a legal charge against the service user’s property as security for the outstanding debt. Carmarthenshire will apply a flat rate charge for this arrangement.
Carmarthenshire will not withdraw services when a person with care and support needs refuses or is unable to pay their assessed charge.
