The County Of Carmarthenshire (County Of Carmarthenshire (With The Exception Of Carmarthen, Llanelli And Ammanford)) (Waiting Restriction And Street Parking Places) Consolidation (Experimental) (Variation Number 40) Order 2023

NOTICE is hereby given that on the 20th day of December 2023 the Carmarthenshire County Council made an Order under Sections 9 and 10 of and paragraph 27 of Schedule 9 to the Road Traffic Regulation Act 1984 (as amended).
The effect of this Order is:
1. To modify The County of Carmarthenshire (County of Carmarthenshire (With the Exception of Carmarthen, Llanelli and Ammanford)) (Waiting Restrictions and Street Parking Places) Consolidation Order 2004 (“the Consolidation Order”) (which provides for decriminalised enforcement of contraventions of waiting prohibitions and restrictions) as though the plans denoting Areas BI177, CV167, DI127, DI128, DH128, DT165, DU164, DU165, DY104, DY105 and DJ171, annexed thereto were substituted with corresponding numbered plans annexed to the experimental Order above recited which said plans shall prevail during the duration of the experimental Order. The consequence of the modification is:
(a) To prohibit waiting at any time on the sides of road and/or in the lengths of road briefly described in column 2 of Schedule 1 to this Notice but more particularly shown on the plans bearing the unique reference number(s) specified in column 3 of the said Schedule for each locality described in column 1 thereof which said plans are to be read in conjunction with the Order and which form part of the same;
(b) To prohibit waiting at any time without exceptions on the side of road and/or in the length of road briefly described in column 2 of Schedule 2 to this Notice; and
(c) To limit waiting to 2 hour with return prohibited within 2 hours at all hours on all days on the side of road briefly described in column 2 of Schedule 3 to this Notice but more particularly shown on the plan bearing the unique reference number specified in column 3 of the said Schedule for the locality described in column 1 thereof which said plan is to be read in conjunction with the Order and which forms part of the same
2. To revoke:
(a) The County of Carmarthenshire (County of Carmarthenshire (With the Exception of Carmarthen, Llanelli and Ammanford) (Waiting Restrictions and Street Parking Places) Consolidation (Variation No. 30) Order 2019
(b) The County of Carmarthenshire (County of Carmarthenshire (With the Exception of Carmarthen, Llanelli and Ammanford) (Waiting Restrictions and Street Parking Places) Consolidation (Variation No. 37) Order 2021
(c) The County of Carmarthenshire (County of Carmarthenshire (With the Exception of Carmarthen, Llanelli and Ammanford) (Waiting Restrictions and Street Parking Places) Consolidation (Variation No. 39) Order 2022
in so far as the same relate to the restrictions briefly described in Schedules 4, 5 and 6 to this notice or relate to the lengths or sides of road more particularly referred to Schedules 1, 2 and 3 and which are subject to the provisions contained or referred to in paragraphs 1(a), (b) and (c) above.
The Order will come into operation on the third day of January, 2024 and a copy of the Order together with the plans showing the lengths and/or sides of road affected and statement of the Council's reasons for making an Experimental Order and the orders being revoked may be examined at Carmarthenshire County Council’s Customer Service Hwb at:

during the usual office hours.

After an initial period of six months the Council will then consider whether the provisions of the Order are to be continued in force indefinitely. If you wish to object to the making of a permanent Order on the terms of the Experimental Order then you should send the grounds for your objection in writing to Linda Rees Jones, Head of Administration and Law at County Hall Carmarthen SA31 1JP by the twenty sixth day of July 2024.
Any person who desires to question the validity of this Order or of any provision contained in it on the grounds that it is not within the powers conferred by the Act or on the grounds that any requirement of the Act or of any instrument made under it has not been complied with in relation to the Order, may, within six weeks of the date on which the Order was made, apply to the High Court for this purpose.

STATEMENT OF REASONS
The restrictions on Cwmamman Road, Garnant are being provided to help to prevent double parking, by keeping the southern side of the road clear of parked vehicles, whilst allowing parking on the northern side of the road where it is safer to do so and to aid forward visibility.
The restrictions at Folland Road, Garnant in the vicinity of Ysgol Y Bedol are being provided to improve road safety, amenity, and navigability for vehicles (including cyclists) and pedestrians, as well as avoiding congestion outside the school. The measures should help to deter parking at this location where it is unsafe to do so and prevent waiting on a nearby junction.
At Colonel Road, Betws a section of existing No Loading/Unloading At Any Time is to be revoked and replaced with Prohibition of Waiting to allow deliveries to local residents, but to prevent general parking near a playground and junction area.
At Portway, Ferryside the revocation in part of the existing restrictions and provision of new restrictions will aid forward visibility to a narrow corner section and aid general road safety by improving forward visibility.
The restrictions at Carmarthen Road, Diana Road and Greenfield Place, Llandeilo will prevent inappropriate parking close to junctions.
The Prohibition of Waiting along Meadows Road, Cross Hands is to be provided to prevent obstructive and long-term parking. The provision of parking places will indicate where it is appropriate to park and the introduction of limits on length of stay will address those pressures created by vehicles belonging to commuters who car share prioritising the available parking for those who live within and visit the area requiring short-term parking.
The removal of the existing time limited parking bay to be replaced by Prohibition of Waiting at High Street, Llangadog, will allow wider traffic lanes and reduce the risk of large vehicle strikes to an existing property.
